("the hotel") or through this Website or any other Website of Eurobuilding Internacional C.A., to which Eurobuilding Internacional C.A. may be linked (collectively referred to as "www.hoteleuro.com services"). Before clicking on the "confirm and pay" button at the end of the booking process, please read these terms and conditions carefully. By clicking on the "confirm and pay" button, you are expressing your consent to be bound by these terms and conditions. If you do not agree with all the terms and conditions, do not click on the "confirm and pay" button. PARTIES
These terms and conditions apply to Eurobuilding Internacional C.A., a company domiciled and registered under the laws of the Bolivarian Republic of Venezuela, in the jurisdiction of the State of Miranda, Caracas, and to anyone who uses this website ("the customer").
USE OF THE SITE
The customer is only authorized to use the website to make legitimate inquiries or bookings and hereby agrees not to make speculative, false, or fraudulent bookings, nor bookings in anticipation of demand for the services of www.hoteleuro.com. Additionally, the customer agrees to provide www.hoteleuro.com with correct and accurate postal, email, or contact information and acknowledges that www.hoteleuro.com may use this data to contact the customer if necessary.
The customer may not reproduce, duplicate, copy, sell, resell, or exploit this site in any way for commercial use unless we grant prior written permission to do so. At our discretion, we may refuse service, interrupt access, and/or cancel transactions.
The customer agrees not to use any device, software, or other instrument to interfere or attempt to interfere with the proper functioning of our site, and also consents not to act with the purpose of imposing an unreasonably large burden on our infrastructure. Additionally, the customer consents not to use any robot, spider, or other automatic or manual process to monitor or copy our web pages or their content without our prior consent (in the case of search engine sites that use standard search technology and whose purpose is to direct Internet users to this site, this consent is deemed given).
The customer is responsible for the information or content submitted, and authorizes us to use that content in accordance with our privacy and security policy. The customer may not post or transmit any material to this site that is considered illegal, defamatory, or profane. The customer also does not have permission to modify or limit any function of this site.
MAKING A RESERVATION
A legally binding reservation will only exist when the customer has entered the necessary data on the relevant webpage and confirmed the reservation by clicking the "Confirm and Pay" button on the corresponding webpage, it has been electronically and expressly accepted by Eurobuilding Internacional C.A., and payment has been made. The customer acknowledges that by clicking on the mentioned "Confirm and Pay" button, they are authorizing www.hoteleuro.com to make the reservation and charge the amount to their credit card as indicated on the website. It is not possible to make a reservation less than two days before the date the customer is due to arrive at the reserved hotel.
Eurobuilding Internacional C.A. may change the price and availability of rooms listed on this site without prior notice.
The customer agrees not to use the information available on this site to advertise or solicit the direct or indirect purchase or sale of products or services such as (but not limited to) hotel reservation services without our express written authorization.
CONFIRMATION
Once the customer has clicked on the "Confirm and Pay" button as indicated above, they must print the electronic confirmation showing the details of the reservation. This confirmation constitutes the basis of the contract for the reservation. THE CUSTOMER ACKNOWLEDGES THAT IT IS THEIR RESPONSIBILITY TO PRINT AND VERIFY THE CONFIRMATION, AND ENSURE THAT ALL DETAILS CONTAINED ARE CORRECT, AS ACCOMMODATION CAN ONLY BE PROVIDED ACCORDING TO THE DETAILS SPECIFIED IN THE CONFIRMATION. IF THE DETAILS IN THE CONFIRMATION ARE INCORRECT, THE CUSTOMER MUST CONTACT WWW.HOTELEURO.COM AT RESERVAS@HOTELEURO.COM SO THAT THEY CAN BE CORRECTED. THE CONFIRMATION MUST BE PRESENTED AT THE HOTEL RESERVATION COUNTER WHEN ARRIVING AT THE DESIGNATED HOTEL (SPECIFY), AS PROOF OF RESERVATION AND PREPAYMENT.
PRICES AND PAYMENT
The price of the services provided by www.hoteleuro.com is specified in the booking form. FULL PAYMENT MUST BE MADE BY CREDIT CARD WHEN MAKING THE RESERVATION. www.hoteleuro.com constantly strives to offer discounts on prices. Furthermore, during trade fairs or other events, hotels may add supplements or not offer the usual reductions, so the price paid by the customer may be higher than the published prices. The customer acknowledges that this situation is beyond the control of www.hoteleuro.com.
CANCELLATIONS AND CHANGES
Cancellations and changes to confirmed hotel reservations are subject to the following conditions: In cancellations, the accommodation for the first night will be charged.
Exceptions: In the case of cancellations made 48 hours or less before the arrival date, the total amount will be charged, which is non-refundable.
One-night reservations - If your reservation is only for one night, a one-night cancellation penalty still applies and therefore cannot be fully refunded.
Cancellation of multiple room reservations - If a one-night cancellation penalty applies, it will be applied to each room reserved.
STAR RATING AND ACCOMMODATION QUALITY
The customer understands and accepts that The Hotel is a five-star hotel according to the laws and regulations of the Bolivarian Republic of Venezuela.
ACCURACY OF INFORMATION
www.hoteleuro.com and its suppliers have taken reasonable steps to ensure that the content of the Website is accurate. www.hoteleuro.com publishes this information in good faith. THE CUSTOMER ACKNOWLEDGES AND ACCEPTS THAT WWW.HOTELEURO.COM CANNOT BE HELD RESPONSIBLE FOR INACCURACIES IN THIS INFORMATION AND THAT WWW.HOTELEURO.COM WILL NOT ACCEPT LIABILITY FOR CHANGES IN SERVICES MADE BY EUROBUILDING INTERNACIONAL C.A. THE CUSTOMER ALSO ACKNOWLEDGES THAT: (1) ALTHOUGH WWW.HOTELEURO.COM STRIVES TO KEEP ALL INFORMATION CONTAINED IN THIS Website UP-TO-DATE AND ACCURATE, WWW.HOTELEURO.COM IS NOT RESPONSIBLE FOR ERRORS, OMISSIONS, OR INCORRECT DATA THAT MAY APPEAR.
LACK OF AVAILABILITY
If a confirmed reservation is not available, www.hoteleuro.com will do its best to offer an alternative hotel of equal or superior quality in the same location, or will refund the full amount if preferred. www.hoteleuro.com will also make an effort to contact the customer before their departure to inform them of this lack of availability. However, the customer acknowledges that this may not always be possible. When it is not possible to contact the customer before they leave, www.hotel-portofino.info will strive to ensure that the hotel in question handles the change of accommodation in the fastest and most efficient manner possible.
COMPLAINTS
Any complaints regarding the hotel must be reported at the hotel reception desk or to the corresponding hotel representative during the customer's stay and sufficient opportunity must be provided to the hotel's management to rectify the situation from the outset. The Hotel will not accept complaints or claims after the customer has left The Hotel premises.
WARRANTIES, REPRESENTATIONS, CONDITIONS, AND TERMS
HEREBY, ALL TERMS, REPRESENTATIONS, CONDITIONS, AND WARRANTIES (WHETHER IMPLIED OR EXPRESS) REGARDING THE SITE AND ANY CONNECTED SERVICES ARE EXCLUDED TO THE EXTENT PERMITTED BY APPLICABLE LAW AND THE COURTS OF THE BOLIVARIAN REPUBLIC OF VENEZUELA.
UNLESS OTHERWISE SPECIFIED, WE PROVIDE THIS SITE "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT PERMITTED BY LAW. USE OF CUSTOMER CONTACT INFORMATION
The customer agrees and consents to the possibility of www.hoteleuro.com using customer contact information (i.e., email address, postal address, or other customer contact data) to contact the customer in the event of an issue with the reservation and for any other information related to the promotion and marketing of Eurobuilding Internacional C.A.
INDENTIFICATION
THE CUSTOMER AGREES TO COMPENSATE AND HOLD WWW.HOTELEURO.COM HARMLESS FROM ANY LIABILITY, DAMAGE, OR LOSS, INCLUDING LEGAL EXPENSES, THAT WWW.HOTELEURO.COM INCURS OR SUFFERS AS A RESULT OF ANY ACTION, INACTION, OR OMISSION ON THE PART OF THE CUSTOMER.
The customer agrees, at their own expense, to indemnify and defend our directors, employees, agents, affiliates, distributors, and licensors from and against any losses, deficiencies, damages, liabilities, costs, and expenses (including expenses and fees incurred from legal services provided by attorneys) incurred in connection with, or arising from any claim, demand, action, or legal proceeding arising out of their breach of these terms of use or in connection with the use the customer has made of this site, or any product or service related to this site.
CONSEQUENTIAL LOSS
UNDER NO CIRCUMSTANCES AND IN NO EVENT SHALL WWW.HOTELEURO.COM OR ITS SUPPLIERS BE LIABLE FOR ANY CONSEQUENTIAL OR SPECIAL DAMAGES, REGARDLESS OF THEIR ORIGIN (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE OR BREACH OF THESE TERMS AND CONDITIONS), OR FOR ANY LOSS OF INFORMATION, PROFITS, REVENUE, OR BUSINESS, REGARDLESS OF THE CAUSE, EVEN IF WWW.HOTELEURO.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE, OR IF IT WAS INFORMED OF THE POSSIBILITY OF IT OCCURRING.
LIMITATION OF LIABILITY
NOTWITHSTANDING THE FOREGOING, THE LIABILITY OF WWW.HOTELEURO.COM TO THE CUSTOMER AND/OR ANY THIRD PARTY SHALL BE LIMITED IN ALL CIRCUMSTANCES TO THE LOWER OF: (A) THE AMOUNT PAID BY THE CUSTOMER FOR THE RESERVATION, OR (B) Bs. 1,000.00, WHICHEVER IS LOWER.
The customer waives any claim against Eurobuilding Internacional C.A. for liability for damages that may arise directly, indirectly, or consequentially from the provision and use of information or services, or from the contracting, acquisition, and use of products.
THE CUSTOMER UNDERSTANDS AND SPECIFICALLY AGREES THAT WE SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE (DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR ANY OTHER TYPE OF LOSS OR DAMAGE) ARISING FROM ACCESS TO, OR USE OF, OR INABILITY TO USE OR ACCESS, OR RELIANCE ON, OR OPERATION OF THIS SITE, OR RESULTING FROM ERRORS OR OMISSIONS IN THE CONTENT OF THIS SITE, REGARDLESS OF THE BASIS FOR CLAIMING LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE.
ASSIGNMENT
The client may not assign, transfer, subcontract, or delegate any rights, duties, or obligations under these terms and conditions without the prior written consent of www.hoteleuro.com.
INTELLECTUAL PROPERTY
The client acknowledges that copyright, trademarks, and other intellectual property rights included and related to this website and the hotel system services are exclusively owned or licensed to www.hoteleuro.com. Reproduction, sale, transfer, or modification of the content or data included in the website without the prior written consent of www.hoteleuro.com is not permitted. Additionally, the client is not authorized to modify, duplicate, display, copy, reproduce, license, publish, transfer, or sell information, software, products, or services obtained from the website without the prior written consent of www.hoteleuro.com. Furthermore, the client acknowledges that they may not use any of these intellectual property rights or www.hoteleuro.com services except to the extent necessary to make a reservation in accordance with these terms and conditions.

The term "force majeure" includes, without limitation, natural disasters, fires, or any other destruction of any reserved accommodation, civil unrest, riots, war or disturbances, exercise of legislative, municipal, military, or other authority, strikes, or any other reason beyond the control of www.hoteleuro.com.
ENTIRE AGREEMENT
These terms contain the entire agreement between www.hoteleuro.com and the client, and supersede any prior deals or agreements (whether oral or written) regarding the subject matter, and may not be changed or modified unless www.hoteleuro.com has previously and in writing agreed to such changes.
APPLICABLE LAW
These terms and conditions are subject to Venezuelan law and the exclusive jurisdiction of the courts of the Bolivarian Republic of Venezuela, in the Miranda State.
